About Our Services
JMO Mengaji Online Centre operates the ‘JMO JomMengaji/ MenuntutIlmu Online’ (herein called JMO) app, which allows sharing of knowledge in Al-Quran (from Iqraa' until khatam Al-Quran) and Academics, anytime, anywhere, via one-to-one or lectures methods, online (via built-in video-calling features), at affordable prices. Mengaji means learn in Malay, or 'menuntut ilmu'. You can increase your knowledge, do revision, and get clarifications from the knowledgeable Teachers. The learning sessions are through use of the built-in video call features, where you can connect to the Teachers at the scheduled date & time. By accessing or using the Service you agree to be bound by these Terms and Conditions. If you disagree with any part of the terms, then you do not have permission to access the Service or use JMO app.
Limitations of Our service
JMO App offers Services to help our users learn and share. JMO does not employ any Teachers.
Purchases
If you wish to purchase any service made available through JMO, you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card. You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.
The service may employ the use of third party services for the purpose of facilitating payment and the completion of Purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy.
We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: service availability, errors in the description or error in your order or other reasons.
We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.
Availability, Errors and Inaccuracies
We are constantly updating product and service offerings on the Service. We may experience delays in updating information on the Service and in our advertising on other web sites. The information found on the Service may contain errors or inaccuracies and may not be complete or current.
We therefore reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.
Accounts
When you create an account with us, you guarantee that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Service.
You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you, without appropriate authorization. You may not use as a username any name that is offensive, vulgar or obscene.
We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion.
Independent Contractor Agreement
TEACHER ENTERS INTO THIS AGREEMENT AS, AND SHALL CONTINUE TO BE, AN INDEPENDENT CONTRACTOR, NOT AN EMPLOYEE. Under no circumstances shall Teachers look to JMO App and or JMO Mengaji Online Centre company as his/her employer, or as a partner, agent, or principal. The Teacher represents that he or she has the requisite educational, academic, or work background necessary to provide the Service(s). As requested, the Teacher shall provide JMO App and Affiliates with all certificates or other evidence of such qualifications. JMO App and Affiliates is not responsible for any educational costs, which the Teachers may incur or be required to incur, including, but not limited to, the cost of obtaining copies of appropriate certificates. The Teacher agrees to defend and indemnify JMO App and Affiliates for any claims, losses, costs, fees, liabilities, damages or injuries suffered by JMO App and Affiliates arising out of the Teacher’s breach of this section. The Teacher further agrees to defend, indemnify and hold JMO App and Affiliates harmless from all claims, losses, expenses, fees (including attorney fees), costs, settlements, and judgments arising out of or related to the Teacher’s performance of the Service(s) or any breach by the Teacher hereunder, or any and all claims arising from the Teacher’s actions, including any alleged tort claims. This indemnity shall survive any termination or expiration of this Agreement.
Intellectual Property
The Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of JMO Mengaji Online Centre. The Service is protected by copyright, trademark, and other laws of both Malaysia and foreign countries. Our trademarks may not be used in connection with any product or service without the prior written consent of JMO Mengaji Online Centre

Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
If you wish to terminate your account, you may simply discontinue using the Service.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
Communications
By creating an Account on our service, you agree to subscribe to newsletters, marketing or promotional materials and other information we may send. However, you may stop receiving any, or all, of these communications from us by unsubscribe on the JMO app.

By creating an Account on our service, you agree for us to promote your teaching services
Indemnification
You agree to defend, indemnify and hold harmless JMO Mengaji Online Centre from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Service.
Limitation of Liability
In no event shall JMO Mengaji Online Centre, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. This will update the ratings and scores of teachers, so that other students can get the best ratings representations of the teachers they are hiring. You will also continue collecting points. So, please do continue using the app to Hire teacher for each and every session you have with Teacher, including offline sessions |
| 29 | Unsucessful hiring | If hiring is unsuccessful, the payment shall be refunded in Points, which can be used for future hiring |
| 30 | Technical issues | JMO tries its best to make the app as problem-free/ bug-free as possible. However, if you are disconnected during session, try to reconnect by going to 'My Session' page, and clicking on the current session name. If reconnection is unsuccessful, or there are other technical problems with the app, wherever possible : 1) Try other meeting app, like Google meet or Zoom 2) If Teacher & Student are nearby, you can request to have a face-to-face meeting Please try to complete the session the best you can, with whatever means necessary (use Chat feature for communication) |
| 31 | Schedule Issue | If Teacher or Student have schedule issue, ie cannot have the session using the app built-in video-call feature, at the scheduled date & time: 1) Try to reschedule using other meeting app, like Google meet or Zoom 2) Or if Teacher & Student are nearby, you can request to have a face-to-face meeting at another mutually agreed date & time Please try to complete the session the best you can, with whatever means necessary (use Chat feature for communication) |

| 35 | Tip | Amount payable to Teacher is after payment gateway charge is deducted from the tip. The payment gateway charges are as follows: 1) For Debit and Credit cards: RM45 and below: 3.85% + RM0.30 + 6% tax of the charge.
